Ses 142 articles structurent un r\u00e9gime pr\u00e9sidentiel avec un syst\u00e8me bicam\u00e9ral et la cr\u00e9ation d\u2019une Cour constitutionnelle.&nbsp;<\/p>\n\n\n\n<p>Le premier article dispose que \u00abLa Tunisie est un Etat libre, ind\u00e9pendant et souverain\u00bb, une disposition \u00e0 mettre en relation avec la s\u00e9paration des pouvoirs temporel et spirituel appliqu\u00e9e dans le pays. L\u2019islam conservera une place privil\u00e9gi\u00e9e en Tunisie, comme le pr\u00e9voit l\u2019article 5 du projet constitutionnel o\u00f9 l\u2019on peut lire que la Tunisie fait \u00abpartie de la oumma islamique\u00bb. L\u2019enseignement de l\u2019islam devra donc \u00eatre garanti par l\u2019Etat, notamment en mati\u00e8re de respect de la vie humaine, de la dignit\u00e9, des biens, de la religion et de la libert\u00e9. Le projet veut aussi rompre avec le parlementarisme, au profit d\u2019un r\u00e9gime pr\u00e9sidentiel. Le pr\u00e9sident serait alors \u00e9lu au suffrage universel direct pour cinq ans, avec un mandat renouvelable une seule fois. Il assurerait le pouvoir ex\u00e9cutif avec l\u2019aide d\u2019un gouvernement et nommerait lui-m\u00eame le Premier ministre. Les membres du gouvernement devront \u00e9galement \u00eatre confirm\u00e9s par le chef de l\u2019Etat lui-m\u00eame. \u00abLe gouvernement veille \u00e0 la mise en \u0153uvre des politiques de l\u2019Etat, conform\u00e9ment aux orientations et aux choix fix\u00e9s par le pr\u00e9sident de la R\u00e9publique\u00bb, dispose ainsi l\u2019article 111 du projet. Le pouvoir l\u00e9gislatif se voit \u00e9galement remodel\u00e9, devenant une \u00abfonction l\u00e9gislative\u00bb occup\u00e9e par un syst\u00e8me bicam\u00e9ral compos\u00e9 par une assembl\u00e9e des repr\u00e9sentants du peuple de la nation et une assembl\u00e9e nationale des r\u00e9gions et des districts. Les repr\u00e9sentants des deux chambres seront \u00e9ligibles au suffrage universel direct. Leur mandat serait incompatible avec une autre fonction r\u00e9mun\u00e9r\u00e9e. Une Cour constitutionnelle est \u00e9galement pr\u00e9vue, compos\u00e9e de neuf magistrats nomm\u00e9s par le pr\u00e9sident de la R\u00e9publique.
