{"id":84073,"date":"2026-03-23T21:03:42","date_gmt":"2026-03-23T20:03:42","guid":{"rendered":"https:\/\/lasentinelle.dz\/?p=84073"},"modified":"2026-03-23T21:03:44","modified_gmt":"2026-03-23T20:03:44","slug":"fiscalite-des-cessions-immobilieres-ce-qui-change","status":"publish","type":"post","link":"https:\/\/lasentinelle.dz\/index.php\/2026\/03\/23\/fiscalite-des-cessions-immobilieres-ce-qui-change\/","title":{"rendered":"Fiscalit\u00e9 des cessions immobili\u00e8res\u00a0: Ce qui change"},"content":{"rendered":"\n<p>La Direction g\u00e9n\u00e9rale des imp\u00f4ts (DGI) a publi\u00e9, le 4 mars 2026, une circulaire \u2014 r\u00e9f\u00e9renc\u00e9e n\u00b009\/MF\/DGI\/LF.2026 \u2014 pr\u00e9cisant les nouvelles r\u00e8gles applicables au calcul de la plus-value immobili\u00e8re soumise \u00e0 l&rsquo;Imp\u00f4t sur le Revenu Global (IRG). Ce texte, qui prend effet r\u00e9troactivement au 1er janvier 2026, vient combler un vide juridique persistant que praticiens et contribuables signalaient depuis longtemps \u00e0 l&rsquo;administration fiscale : celui des biens c\u00e9d\u00e9s sans prix d&rsquo;acquisition connu ou tra\u00e7able. Le principe g\u00e9n\u00e9ral pos\u00e9 par l&rsquo;article 78 du Code des Imp\u00f4ts Directs et Taxes Assimil\u00e9es (CIDTA) n&rsquo;a pas chang\u00e9 dans sa logique : la plus-value imposable \u00e0 l&rsquo;IRG \u00ab est constitu\u00e9e par la diff\u00e9rence positive entre le prix de cession du bien et son prix d&rsquo;acquisition ou la valeur de sa cr\u00e9ation par le c\u00e9dant \u00bb, rappelle la circulaire. C&rsquo;est dans l&rsquo;application de ce principe que r\u00e9sidait la difficult\u00e9. Sur le march\u00e9 immobilier alg\u00e9rien, une partie significative des transactions porte sur des biens anciens dont l&rsquo;historique patrimonial est lacunaire : propri\u00e9t\u00e9s familiales d\u00e9membr\u00e9es au fil des g\u00e9n\u00e9rations, transmissions non formalis\u00e9es, actes dont la valeur du bien n&rsquo;est pas mentionn\u00e9e, livrets fonciers sans indication de prix. Dans tous ces cas, le calcul de la plus-value \u00e9tait impossible ou contestable, cr\u00e9ant une ins\u00e9curit\u00e9 juridique autant pour le contribuable que pour l&rsquo;administration. La loi de finances pour 2026, en son article 9 modifiant l&rsquo;article 78 du CIDTA, tranche d\u00e9sormais la question par une solution forfaitaire. La DGI indique que le nouveau dispositif pr\u00e9voit \u00ab la prise en compte d&rsquo;un montant calcul\u00e9 forfaitairement, sur la base du prix de vente du bien, objet de cession, en tant que prix d&rsquo;acquisition ou valeur de cr\u00e9ation \u00bb. Concr\u00e8tement, \u00ab en cas d&rsquo;impossibilit\u00e9 de d\u00e9termination du prix d&rsquo;acquisition ou de cr\u00e9ation d&rsquo;un bien objet de cession, pour les besoins du calcul de la plus-value imposable \u00e0 l&rsquo;IRG \u00bb, ce prix est d\u00e9sormais \u00ab fix\u00e9 forfaitairement \u00e0 quarante pour cent (40 %) du prix de vente \u00bb. En d&rsquo;autres termes, le fisc consid\u00e8re que le vendeur a acquis le bien pour 40 % de ce qu&rsquo;il en tire aujourd&rsquo;hui, et c&rsquo;est sur la diff\u00e9rence \u2014 soit les 60 % restants, d\u00e9duction faite des droits, taxes et frais justifi\u00e9s li\u00e9s \u00e0 la vente \u2014 que l&rsquo;imp\u00f4t est calcul\u00e9. La circulaire illustre ce m\u00e9canisme par un exemple chiffr\u00e9 : pour un bien vendu 10 millions de dinars dont le prix d&rsquo;acquisition original est inconnu, le forfait de 40 % correspond \u00e0 4 millions de dinars. La plus-value taxable est donc la diff\u00e9rence entre les 10 millions per\u00e7us et ces 4 millions forfaitaires, diminu\u00e9e des frais de vente d\u00fbment justifi\u00e9s. Un calcul simple, mais dont l&rsquo;impact fiscal peut \u00eatre significatif selon la date r\u00e9elle d&rsquo;acquisition du bien et l&rsquo;\u00e9volution de sa valeur sur le march\u00e9.<\/p>\n\n\n\n<p>La DGI apporte une pr\u00e9cision d&rsquo;importance sur ce point : \u00ab lorsque le prix d&rsquo;acquisition ou de cr\u00e9ation d&rsquo;un bien, objet de cession, est d\u00e9termin\u00e9 forfaitairement, il n&rsquo;y a pas lieu de tenir compte, pour les besoins du calcul de la plus-value de cession imposable \u00e0 l&rsquo;IRG, des \u00e9ventuels frais d&rsquo;acquisition, d&rsquo;entretien et d&rsquo;am\u00e9lioration, qui auraient \u00e9t\u00e9 support\u00e9s par le vendeur, m\u00eame lorsque ceux-ci sont d\u00fbment justifi\u00e9s. \u00bb Cette exclusion est notable : un propri\u00e9taire qui aurait r\u00e9alis\u00e9 d&rsquo;importants travaux sur un bien ancien ne pourra pas les d\u00e9duire d\u00e8s lors que le forfait de 40 % est appliqu\u00e9. Le m\u00e9canisme est exclusif : on choisit soit le prix r\u00e9el avec les frais r\u00e9els, soit le forfait sans aucun frais suppl\u00e9mentaire.<\/p>\n\n\n\n<p>Cette r\u00e9forme s&rsquo;inscrit dans un mouvement plus large de rationalisation et de simplification de la fiscalit\u00e9 immobili\u00e8re en Alg\u00e9rie, \u00e0 un moment o\u00f9 le march\u00e9 de l&rsquo;immobilier conna\u00eet une tension notable sur les prix, notamment dans les grandes agglom\u00e9rations. Elle r\u00e9pond aussi \u00e0 un imp\u00e9ratif de rendement fiscal : en encadrant le calcul de la plus-value pour les biens sans historique de prix, l&rsquo;\u00c9tat r\u00e9duit les marges d&rsquo;optimisation et s\u00e9curise une ressource fiscale qui lui \u00e9chappait en partie.
